Affidavit of service filed by the petitioner is taken on record. The petitioner who is the Pradhan of Margram Gram Panchayat submitted applications seeking removal of the private respondents under Section 11(1) of The West Bengal Panchayat Act, 1973 which are yet to be considered. The petitioner seeks consideration of the same at the earliest. In the meantime, a no confidence motion has been submitted for removal of the petitioner by the members of the Panchayat including the private respondents herein. Prayer (f) made by the petitioner in this regard is not pressed. It is a fact that no time frame has been prescribed for
consideration of applications submitted under Section 11 of the Act of 1973. However, that does not mean that the concerned authority shall sit over the same indefinitely.
2 Since the applications were submitted in June, 2026, the Prescribed Authority and the Block Development Officer, Khargram Development Block, being the 5th respondent herein, is directed to consider and dispose of the same within three weeks from the date of communication of this
order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
