NO.5041/2024 (CRIME NO.50/2024) OF BANNERUGATTA POLICE STATION, FOR OFFENCE PUNISHABLE Digitally signed by SHARADAVANI B Location: High Court of Karnataka - 2 - HC-KAR CNR: KAHC010180472026 NC: 2026:KHC:37391 CRL.P No. 3926 of 2026 UNDER SECTION 302, 397, 201 OF IPC. WHICH IS PENDING BEFORE THE HONBLE III ADDL. DISTRICT AND SESSIONS JUDGE, ANEKAL BENGALURU RURAL. THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S VISHWAJITH SHETTY ORAL ORDER This successive petition under Section 483 of BNSS 2023 is filed by the accused in S.C.No.5041/2024 pending before the court of III Additional District and Sessions Judge, Bangalore Rural District sitting at Anekal arising out of crime No.50/2024 registered by Bannerghatta Police Station, Bangalore for the offences punishable under Sections 302, 397 and 201 of IPC. 2. Heard the learned counsel for the parties. 3. Learned counsel for the petitioner submits that the petitioner is in custody from 04.03.2024 and till date trial in the case has not commenced. He further submits that the petitioner is a student and therefore requests to consider his period of incarceration for grant of regular bail - 3 - HC-KAR CNR: KAHC010180472026 NC: 2026:KHC:37391 CRL.P No. 3926 of 2026 4. Learned HCGP brings to the notice of this Court that the petitioner is a person with criminal antecedents and there are as many as 13 criminal cases registered against him before police stations in Andhra Pradesh and also in Karnataka. He further submits that before the trial court summons has been issued to CW1 to CW3 and therefore at this stage if petitioner's bail application is considered, the progress in the trial may be hampered. 5. The petitioner had earlier approached this Court in Crl.P.No.11190/2024, which was dismissed as not pressed, with a request to expedite the trial and dispose of the case at the earliest. No change in circumstances is pointed out to entertain this successive bail petition. The petitioner is a person with criminal antecedent, and as rightly contended by the learned HCGP, in the event he is enlarged on bail, the progress before the trial court in S.C.No.5041/2024, in which summons is already issued to CW1 to CW3, may be hindered. Considering the antecedents of the petitioner and also the stage of the trial before the trial S.C.No.5041/2024, I am of the view that at this - 4 - HC-KAR CNR: KAHC010180472026 NC: 2026:KHC:37391 CRL.P No. 3926 of 2026 stage the petitioner's prayer for the grant of regular bail cannot be entertained. Accordingly, the petition stands dismissed. Sd/- (S VISHWAJITH SHETTY) JUDGE HDK List No.: 1 Sl No.: 33
