By the present petition, the petitioner has prayed for following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to make payment of gratuity to the petitioner holding the action of withholding gratuity amount illegal. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to make payment of gratuity amount to the petitioner along with interest for the delay in payment. 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to take decision over the representation of petitioner dated 09-04-2026 (Annexure P-11). 10.4 That, Any other relief, which this Hon'ble Court deems fit and proper, May also kindly be granted to the petitioner, in the interest of justice” 2. Learned counsel for the petitioner submits that the petitioner retired from the post of Account Officer on 30.09.2025. However, despite his retirement, the gratuity amount payable to him has not been released and continues to remain withheld. It is further submitted that the petitioner has already submitted a representation (Annexure P-11) before the competent authority seeking release of the withheld gratuity amount, but the said representation has not yet been considered or decided. 3 3. Per contra, learned counsel appearing for the respondents submits that if the petitioner's representation is still pending consideration, the same will be decided and an appropriate order will be passed within a period of 45 days. 4. I have heard learned counsel for the parties and perused the pleadings and documents available on record. 5. Considering the submissions advanced by learned counsel for the parties and without expressing any opinion on the merits of the case, the present writ petition is disposed of with a direction to the Director, Directorate of Urban Administration and Development, Nava Raipur, and the Commissioner, Municipal Corporation, Durg, to consider and decide the petitioner's representation (Annexure P-11) by passing a reasoned and speaking order, in accordance with law, within a period of 45 days from the date of receipt of copy of this order.
