VIBHU BAKHRU, CHIEF JUSTICE) 1. The State has filed the present petition seeking review of the order dated 25.07.2024 in WP.No.19131/2024 (GM-MM-S). The respondent had filed the said petition, inter alia, praying that - 3 - HC-KAR CNR: KAHC010092762026 NC: 2026:KHC:36801-DB RP No. 57 of 2026 directions be issued to the respondent No.2, Deputy Commissioner, to issue a challan for depositing the fine as per Rule 107 of the Karnataka Land Revenue Rules for seeking an order for deemed conversion of land measuring 11 acres, out of 35 acres comprising Survey No.28/17 situated in Ramapur Village, Ramadurga Taluk, Belagavi District (subject land). 2. The writ petitioner claimed that he is the absolute owner of the subject land and therefore was entitled to deemed conversion in terms of Section 95 of the Karnataka Land Revenue Act, 1964. The said contention was accepted, and the petition was allowed. The State now contends that the subject land does not belong to the writ petitioner and therefore, the writ petitioner’s application for conversion of the subject land cannot be entertained. 3. Clearly, the title of the subject land was neither the issue in the writ petition nor the subject matter of the order dated 25.07.2024. Paragraph 3 of the order expressly records the writ petitioner's assertion that he is the absolute owner of the subject land. - 4 - HC-KAR CNR: KAHC010092762026 NC: 2026:KHC:36801-DB RP No. 57 of 2026 4. In the aforesaid view, it is not necessary to review the said order, except to clarify that the said order cannot be construed as directing deemed conversion under Section 95(9) of the Karnataka Land Revenue Act, 1964 without the necessary factual foundation for attracting the said provision. The State is not precluded from examining the writ petitioner's application for deemed conversion in accordance with law. We also note that the present review petition has been filed after an inordinately long delay of 529 days. However, in view of the above, we consider it apposite to condone the delay as well. 5.
