2. It transpires from the bail application that the applicant is in jail since 20.10.2024. Hence, the Court proceeds to consider and hear the bail application of the applicant with the assistance of the State counsel. 3. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail, as he has been arrested in connection with Crime No.310/2024, registered at Police Station Pendra, District- Gaurela Pendra Marwahi (C.G), for the offences punishable under Sections 20(B), 29 of NDPS Act. 4. The case of the prosecution, in brief, is that on 20.10.2024, on the basis of secret information, the police of Police Station Pendra intercepted a car bearing registration No. MH-02/EH-1015 and, upon checking its dickey, seized about 34.300 kg of illegal narcotic substance. During investigation, a co-accused, in his memorandum statement, disclosed the involvement of the present applicant along with other persons in transporting and selling the narcotic substance using another vehicle. On the basis of the said disclosure, the present applicant was arrested and the offence was registered against him. Hence, the bail application. 5.
The learned counsel for the State opposes the bail application and submits that charge-sheet has been filed in the present case and contraband article i.e. 34.300 Kgs of Ganja was seized from the possession of co-accused and the said co-accused persons in
3 their memorandum statement disclosed that present applicant is also involved in the present case as his role was piloting the co- accused persons who were carrying the contraband article, which is above the commercial quantity. She further submits that the bail applications of three of the co-accused persons, namely, Homendra Singh, Shekhar Pal and Rameshwar Ahiwar @ Munna have already been rejected by this Court vide orders dated 12.01.2026, 04.11.2025 and 08.08.2025 in MCRC Nos.288/2026, 8742/2025 and 6301/2025, therefore, present applicant is not entitled for grant of bail. 6. I have perused the case diary. 7. From perusal of the records and pleadings made in the bail application, it prima facie appears that the contraband article seized i.e. 34.300 Kgs of Ganja, which is above the commercial quantity as per the Schedule given under the NDPS Act recovered from the possession of co-accused persons and the said co- accused persons, in their memorandum statements, disclosed that the present applicant is also involved in the present case, alleging that his role was to pilot the co-accused persons who were carrying the contraband article. So far as status of trial is concerned, it transpires from the bail application that some of the prosecution witnesses have turned hostile, but the same amounts to only tempering with the evidence. Furthermore, bail application of three of the co-accused persons, namely, Homendra Singh, Shekhar Pal and Rameshwar Ahiwar @ Munna have already
4 been rejected by this Court vide orders dated 12.01.2026, 04.11.2025 and 08.08.2025 in MCRC Nos.288/2026, 8742/2025 and 6301/2025. As such in view of the seriousness of the offence, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 8.
Accordingly, the bail application of the applicant - Dewanshu Mogre @ Bablu, involved in Crime No.310/2024, registered at Police Station Pendra, District- Gaurela Pendra Marwahi (C.G), for the offences punishable under Sections 20(B), 29 of NDPS Act, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
