24.07.2026 IN THE HIGH COURT AT CALCUTTA Item No.275 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (M) 1501 of 2026 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/Section 439 of the Code of Criminal Procedure, 1973 filed in connection with Khargram Police Station Case No. 231 of 2023 dated 08.07.2023 under Sections 364/302/120B of the Indian Penal Code. And In Re : Tasir Sk. ... Petitioner. Mr. Shamim ul Bari, Mr. Raju Mondal, Mr. Masooq Rahman, Ms. Ashmita Mitra ... For the Petitioner. Dr. Pradip Banerjee, APP, Mr. Suman Chakraborty ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 2 months and out of 33 witnesses cited by the prosecution, till date, only three witnesses have been examined. It has been submitted that there is no possibility of the trial concluding in near future. As such, petitioner may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are three other criminal cases against the present petitioner. The case has taken a shape after the CID was handed over with the investigation. Presently the trial has commenced. Having regard to the overall circumstances of the case, I am of the opinion that at this stage prosecution 2 should be granted an opportunity to examine vulnerable witnesses. At this stage, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the evidence of the vulnerable witnesses is over. Report submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1501 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
