Applicant has filed this third bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as PRASHANT DEWANGAN Digitally signed by PRASHANT DEWANGAN Date: 2026.08.01 17:19:23 +0530 2 he has been arrested in connection with Crime No. 469/2023 registered at Police Chowki- Junapara, Arakshi Kendra- Takhatpur, District- Bilaspur (C.G.) for offence punishable under Sections 365, 364, 368, 302, 201, 120B of the Indian Penal Code, 1860. First bail application of the present applicant was dismissed on merits by this Court vide order dated 15/04/2024 in MCRC No.1404/2024. Thereafter, the second bail application of present applicant was withdrawn vide order dated 12/01/2026 in MCRC No.10479/2025. 2. Case of prosecution is that, on 02.09.2023 Bhagwan Ram Bishnoi (hereinafter for brevity referred to as deceased) have left his farmhouse for his home at about 07:42 P.M. on his motorcycle bearing no. CG 10 AL 1334 to Kota, District - Bilaspur. When he did not reach to his house for quite long time, Shravan Kumar Bishnoi went out for his search and during his search, he saw the dead body of Bhagwan Ram Bishnoi (deceased) near Bandhia Talab, Bashajhal. Prior to the finding of the dead body of the deceased, near the place of lying of the dead body, accused Sanam Ansari along with other friends were found present with one white I-20 Car bearing no. MP-20-CL-9305. However, when they went to search and saw the dead body of the deceased, after sometime, accused Sanam Ansari along with other friends and car was not found at that place. The incident was reported to the concerned police station and based upon which, the aforementioned crime was registered initially, against the suspect 3 Sanam Ansari. During the course of investigation, applicant was arrested on 05.09.2023. 3. Learned counsel for applicant submits that applicant has been falsely implicated in the crime, he has not committed any offence as alleged. He further submits that after dismissal of first bail application, one of the important witness, as namely, Kirti Yadav was examined before trial Court and he has not supported the case of the prosecution. He further submits that trial may take considerable time to conclude, applicant is in jail since 05/09/2023, hence he may be enlarged on bail. 4. On the other hand, learned State counsel opposes the submission made by learned counsel for applicant and would submit that the applicant has borrowed the car bearing No. MP-20-CL-9305 from its original owner- Md. Zaheer, which is appearing in the CCTV footage of toll-plaza collected by the police during the course of investigation. The car came to Chhattisgarh and also returned from the Chhattisgarh. In the car, blood stains were found. He further referring to the deposition of Rakesh (PW-4), submitted that he has supported the case of prosecution. 5. I have heard learned counsel for the parties and perused the documents enclosed along with the bail application. 6. Considering the submission made by learned counsel for the respective parties, nature of allegations, facts and circumstances of the case and, the materials available in the charge-sheet, I do 4 not find present to be a fit case to allow the application, accordingly, application is dismissed. 7. At this stage, learned counsel for the applicant submits that applicant is in jail since 05/09/2023, therefore, direction be issued to learned trial Court to expedite the trial. 8. On due consideration of submission of counsel for the applicant and also the date of arrest, the learned trial Court concerned is directed to expedite the trial and to take all necessary steps as provided under BNSS to cause presence of prosecution witnesses for early conclusion of the trial. 9.
