And In the matter of : Suman Sardar. ……Petitioner. Mr. Abdul Aziz Mondal .....for the Petitioner. Mr. Sayan Mukherjee ……for the State. Learned advocate appearing for the petitioner submits that the quantum of seizure in the present case is of intermediate quantity and petitioner has been implicated on the basis of the statement of the co-accused. Learned advocate appearing for the State opposes the prayer for bail. On a specific query learned advocate submits that there are no call detail records available in the Case Diary. Charge-sheet has already been submitted. Having regard to the same, I am inclined to allow the prayer for anticipatory bail. As such, I direct that in the event of arrest, the petitioner namely, Suman Sardar shall furnish bond subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) 2 of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since, charge-sheet has been submitted, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 2143 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
