This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.585/2025 registered at Police Station Bodhghat, District Bastar (C.G.) for the offence under Section 20 (B) of the NDPS Act. 2. Case of the prosecution is that on the basis of secret information KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.08.01 12:22:48 +0530 2 received by the concerned Police, the applicant/accused, Somnath Sahu, was intercepted and searched in accordance with law. During search, a blue printed backpack allegedly found in his conscious possession was recovered, from which five packets containing 3.806 kilograms of Hashish Oil (Cannabis Oil), a narcotic drug, were seized. Thereafter the offence was registered against the present applicant. Hence the bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. The alleged recovery of Ganja Oil is below the notified commercial quantity. The applicant is in jail since 11.12.2025. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that as per the Schedule appended with the NDPS Act, permissible quantity of the contraband has been prescribed as 1 kg whereas in the present case the seized quantity of contraband i.e. 3.806 kilograms of Hashish Oil (Ganja Oil) is above the permissible quantity, and the charge sheet has been submitted against the applicant. Therefore, the present bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and the fact that the charge sheet has already been submitted 3 against the applicant and considering the quantity of the contraband recovered from possession of the applicant i.e. 3.806 kilograms of Hashish Oil, which appears to be above the permissible quantity, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of applicant – Somnath Sahu involved in Crime No.585/2025 registered at Police Station Bodhghat, District Bastar (C.G.) for the offence under Section 20 (B) of the NDPS Act, is rejected. - Sd/- (Ramesh Sinha) Chief Justice Barve
