This is the third bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking grant of regular bail to the applicant in connection with Crime No. 300/2025 registered at Police Station – Civil Line, Bilaspur, District Bilaspur (C.G.) for the offences punishable under Sections 34(2) and 59(a) of the C.G. Exicse Act. 2. The first and second bail applications preferred by the applicant were rejected by this Court in MCRC No. 4508/2025 and MCRC No. 9130/2025 vide orders dated 10.07.2025 and 13.11.2025 respectively, primarily on the ground of the applicant's criminal antecedents. Learned counsel for the applicant submits that the present bail application may be dismissed as withdrawn, as the trial has almost concluded and only pronouncement of judgment remains. He further submits that he does not wish to press the present bail application and accordingly seeks permission to withdraw the same. 4. Learned State counsel has no objection to the prayer made by learned counsel for the applicant. 5. Considering the submissions advanced by learned counsel for the parties and upon perusal of the record, it appears that the first and second bail applications of the applicant were rejected by this Court in MCRC No. 4508/2025 and MCRC No. 9130/2025 vide orders dated 10.07.2025 and 13.11.2025 respectively on the ground of the applicant's criminal antecedents. Though learned counsel for the applicant submits that the trial has almost concluded and only pronouncement of judgment remains, this Court finds that the present bail application suffers from various defects pointed out by the Registry. On a pointed query being made, learned counsel for the applicant fairly submits that the defects have not been cured till date as per rules. Since the defects still remain uncured despite sufficient opportunity, this Court is of the considered opinion that the present third bail application is dismissed on the ground of non- removal of the defects.
