Though service upon the private respondents is not complete, in view of urgency involved in the matter, the matter is taken up for consideration upon dispensation of service under Rule 26 of the High Court Appellate Side Rules. The petitioners are members of Mathurapur Panchayat Samiti and submitted a no confidence motion for removal of the Sabhapati of the Samiti before the Prescribed Authority on 13th July, 2026 which was received by the latter on the same date. By a notice issued on 17th July, 2026, the Prescribed Authority fixed the date of meeting on 27th July, 2026, that is, this day. The said authority sought police assistance for maintenance of law and order in the meeting. The authority was informed by the police authority by a letter issued on 20th July, 2026 that adequate police personnel could not be spared to ensure proper security arrangements for the meeting. The petitioners seek a 2 direction upon the police authority to provide necessary assistance so that the meeting can be held without any hindrance. It is extremely shocking to note that in the letter issued on 20th July, 2026, the police authority has requested postponement of the meeting till completion of Durga Puja, Kali Puja and Gangasagar Mela. Learned counsel for the State submits that the meeting be directed to be held tomorrow, that is, on 28th July, 2026 at 11 am. Accordingly, this Court directs that the meeting shall be held on 28th July, 2026 at 11.00 am. Notice of the meeting be served upon the members of the Panchayat by the Prescribed Authority prior to holding the meeting. The Officer in charge, Mathurapur Police Station being the 11th respondent herein, is directed to provide necessary assistance to the Prescribed Authority so that the meeting is held peacefully without any disturbance from any corner whatsoever. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 3 Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
