3. The accused/applicant has moved this third bail application under Section 438 of BNSS, 2023 for releasing him on regular bail Digitally signed by VIJAY BHARATRAO PEKDE Date: 2026.07.31 11:04:11 +0530
2 during trial in connection with Crime No.195/2025 registered at Police Station – Dongargarh, District Rajnandgaon (C.G.) for the offence punishable under Section 103(1) and 115(1) of BNS.

Earlier, vide order dated 18.02.2026, the first bail application being MCRC No.1357/2026 filed by the applicant was rejected with direction to the Trial Court to expedite the trial and conclude the same within a period of 04 months. However, before expiry of the said period, the applicant again preferred second bail application being MCRC No.4270/2026 which was also rejected on the ground that the time granted to the Trial Court for concluding the trial had not yet expired.
5. The applicant has now preferred the present third bail application. In the present proceeding, vide order dated 22.07.2026, this Court called for a status report from the Trial Court. In its report dated 27.07.2026, it has been stated that the earlier orders of this Court dated 18.02.2026 and 07.05.2026 were not brought to the notice of the present Presiding Officer by the concerned clerk, due to which no application seeking extension of time could be filed. It has further been reported that only two prosecution witnesses remain to be examined and the trial is at its final stage. The Trial Court has also informed that an inquiry has been proposed against the concerned clerk for the said lapse, and has sought an extension of one month’s further time to conclude the trial.
6. Considering the prayer made, one month further time is granted to the Trial Court to conclude the trial of the case.

Learned counsel for the applicant confines his prayer to seeking permission to withdraw the present bail application, with liberty to file a fresh bail application in the event the trial is not concluded within one month.
8. Learned State counsel opposes the bail application.

9. Considering the aforesaid facts and circumstances of the case, the third bail application of the applicant is dismissed as withdrawn reserving liberty to the applicant to file fresh bail application if the trial is not concluded within one month.
10. Accordingly, the bail application filed under Section 483 of BNSS, 2023 is rejected with liberty as afore-stated.
11. The Principal District and Sessions Judge, Rajnandgaon, is
directed to ensure strict adherence to the time-bound directions issued by this Court. He shall also conduct an inquiry into the lapse resulting in not placing the earlier orders of this Court before the Presiding Officer and ensure appropriate action against the officials found responsible.
