Order 29/04/2026
1. At the request of the learned counsel appearing for the petitioner, the present writ petition has been taken up and heard for final disposal at the admission stage itself.
2. The limited grievance of the petitioner is that she was a contractual employee directly working with the respondents. She submitted a resignation letter on 26.02.2026 (Annex.6) and subsequently, she changed her mind and, therefore, she submitted a withdrawal application on 17.03.2026 (Annex.10) seeking withdrawal of the resignation letter.
[2026:RJ-JP:18186] (2 of 2) [CW-6325/2026]
3. The learned counsel appearing for the petitioner submits that whenever an employee desires to quit the employment, she has to give 15 days’ notice to the employer and since, in the present case, the petitioner did not comply with the said condition, the application which was filed seeking resignation shall not be taken as a valid application. It is also his submission that she has filed an application for withdrawal of the resignation letter before an
order of acceptance is passed thereon.
4. Without going into the merits of the case, this Court is inclined to dispose of the present writ petition with certain directions to the respondents.
5. In the result, the present writ petition is disposed of, directing the respondents to consider the application for withdrawal of the resignation letter. If the resignation is not accepted before receipt of the application for withdrawal of the resignation letter, necessary orders shall be passed allowing the petitioner to discharge her duties. Such orders shall be passed within a period of 15 days from the date of receipt of a copy of this order.
