By the present writ petition the petitioner seeks direction upon the respondent authorities to disburse interest on delayed payment of revised gratuity and arrear pension amount from the date of effect of ROPA 2009 till the date of actual payment at the rate of 18% per annum. 2. The petitioner contends that he was an Assistant Teacher of Sahara-II Primary School, P.O.- Sahara, District-Purba Medinipur under Egra West Circle Post Office Chorepalia in the District of Purba Medinipur. The petitioner retired from service on superannuation on 31st December, 2008. The first Pension Payment Order was issued in favour of the petitioner 17th March, 2009. The revised Pension Payment Order as per ROPA 2009 was issued on 13th November, 2025. The petitioner is entitled to revised gratuity and arrear pension from the date of effect of ROPA 2009
i.e. 19th May, 2009. However, no interest has been paid on the delayed payment of revised arrear pension. Hence this writ petition. 3. Mr. Dilip Kumar Sadhu, learned Advocate appearing for the petitioner produces copy of the revised pension payment order under ROPA, 2009 issued on 13th November, 2025 which is taken on record. He informs the court that the arrears have been disbursed to the petitioner on 19th December, 2025. He seeks for interest on delayed payment on revised gratuity and arrear pension amount from the date of effect of ROPA, 2009, i.e. 19th May, 2009. 4. Mr. Brijendra Pratap Singh, learned advocate for the State leaves the matter to the discretion of the Court. 5. In terms of ROPA, 2009 the petitioner is entitled to receive the revised gratuity and arrear pension amount from the date of effect of ROPA, 2009, i.e. 19th May, 2009. The revised gratuity and arrear pension is disbursed on 19th December, 2025. As such, the petitioner is entitled to interest on the aforesaid amount. 6.
Accordingly, respondent no.2, Director of Pension, Provident Fund and Group Insurance and respondent no.3, Treasury Officer, Egra are directed to pay the interest at the rate of interest @ 8% per annum on the revised gratuity and arrear pension in favour of the petitioner on and from the date of effect of ROPA, 2
2009 i.e. 19th May, 2009 till the date of actual payment. 7. Such payment is to be made within a period of eight weeks from the date of communication of this order. 8. Learned advocate for the petitioner is directed to communicate this order to the respondent no.2, Director of Pension, Provident Fund and Group Insurance and respondent no.3, Treasury Officer, Egra for necessary action. 9. With the aforesaid directions, the writ petition being WPA 22470 of 2025 is disposed of. 10. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 11. Interim order, if any, stands vacated. 12. All connected applications, if any, stand disposed of. 13. There shall be no order as to costs. 14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 15.
