And In the matter of : Mridul Kanti Mondal. ……Petitioner. Mr. Uday Sankar Chattopadhyay Ms. Aishwarya Datta .....for the Petitioner. Ms. Madhurai Sinha ……for the State. Learned advocate appearing for the petitioner submits that petitioner is similarly situated as one Jiyarul Mollick who has been granted anticipatory bail. Learned advocate appearing for the State opposes the prayer for bail. I have taken into account the statement of the injured as well as the other witnesses. I have also taken into account the injury report. So far as the locus of the present petitioner and the said Jiyarul Mollick who has been granted anticipatory bail is on the same footing, I am inclined to extend the same benefit to the present petitioner. As such, prayer for anticipatory bail of the petitioner is allowed. Accordingly, I direct that in the event of arrest, the petitioner namely, Mridul Kanti Mondal shall furnish bond subject 2 to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since, the investigation of the case is in progress, petitioner shall within 10 days meet firstly with the investigating officer of the case and thereafter make himself available as and when called for by the investigating officer of the case. Accordingly, CRM (A) 2079 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
