JUSTICE M.NAGAPRASANNA - 3 - HC-KAR NC: 2026:KHC:18505 CRL.P No. 3790 of 2026 ORAL ORDER Learned counsel for the petitioner submits that the parties to the lis have settled the dispute among themselves by drawing up a Matrimonial Settlement Deed and have placed it before the concerned Court in O.P.No.1439/2025 at Hyderabad. The settlement drawn also indicates the closure of the present proceedings i.e. C.C.No.4467/2020. 2. The terms of settlement relevant to the present case reads as follows: "2. It is submitted that the Petitioners No.1 & 2 herein lived together for some period only and during this period differences arose between them and differences grew to such an extent where they could not stay together as therein non-compatibility to lead matrimonial life together and started living separately from January 2020, since then Petitioner No.2 is living separately from the Petitioner No.1. 4. It is submitted that the marriage between the Petitioners is irrevocably broke down and they are not able to live together, as such they have decided to dissolve the marriage - 4 - HC-KAR NC: 2026:KHC:18505 CRL.P No. 3790 of 2026 between them by getting divorce under mutual consent, as such the petitioners agreed for divorce under mutual consent. 5. That, both the Petitioners entered into agreement of matrimonial settlement deed and reduce their terms and conditions in writing, according to the conditions of the Petitioner No.2 she should withdraw all criminal cases including DVC Case (already dismissed in default) bearing DVC No. 31/2020 by VI Metropolitan Magistrate, CC NO.4467/2020 Pending before VII Addl. Chief Metropolitan Magistrate Court at Bangalore, filed by Petitioner No.2 in Bangalore as per conditions of Final Matrimonial Settlement. 8. The Petitioner No.2 filed Divorce Petition U/s 13 (1) (ia) of Hindu Marriage Act 1955 which is pending before II Additional Family Court Judge at Kalapataru Hyderabad bearing O.P No.24/2024 and the same is NOT PRESSING by the Petitioner No.2 after filing Divorce in a mutual consent.", 3. In the light of the settlement arrived at between the parties, the petition is disposed of. - 5 - HC-KAR NC: 2026:KHC:18505 CRL.P No. 3790 of 2026 The entire criminal proceedings in C.C.No.4467/2020 (Crime No.007/2020), filed by respondent No.1 police for the offence punishable under Sections 498(A), 323, 504, 506 of IPC and Section 4 of Dowry Prohibition Act, by compounding the offences initiated by respondent No.1, pending on the file of learned XLI Additional Chief Judicial Magistrate, Bengaluru, are hereby quashed.
