Being aggrieved by and dissatisfied with the continuation of the impugned proceeding being Complaint Case No. 680/2024 under Section 12 read with Section 23 of the Protection of Women from Domestic Violence Act, 2005, learned Counsel for the petitioner/husband submits that the said application under Section 12 read with Section 23 of the Act of 2005 was filed on 20th February, 2024. Thereafter interim monetary relief has been granted to the opposite party herein/wife to the tune of Rs.40,000/- per month. 2. The husband/petitioner is paying said amount of monthly monetary relief month by month. The opposite party/wife after obtaining order of interim monetary relief is now trying to drag the proceeding and as such appropriate 2 direction may be passed upon the Trial Court for expeditious disposal of the said proceeding. 3. Having heard learned Counsel for the petitioners, it appears that the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer made in the application the opposite party/wife will have no cause to prejudice and as such service of copy of application upon the opposite party is dispensed with. 4. Having heard learned Counsel for the petitioners and that the application is pending for disposal for about two and half years, I find that the prayer made by the petitioners is justified and required to be allowed to secure the ends of justice in view of the specific time limit envisaged in the Statute under Section 12(5) of the D.V. Act. 5. In view of above, the instant proceeding being CRR/2813/2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the aforesaid Complaint Case being No. 680/2024, presently pending before learned Additional Judicial Magistrate, Bidhannagar and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing. 6.
