1. By the present petition, the petitioners have prayed for
3 following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ/order/direction, thereby directing respondent authorities to grant the pay scale treating as temporary employee and grant difference amount payable on temporary employee till date of their regularization as per the work charge and contingency paid employee rules. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ/order/direction, thereby directing the respondent authorities to consider the representations preferred by petitioners considering the contribution and work experience of petitioners. 10.3 That, any other relief/ order which may deem fit and just in the facts and circumstances of the case including the costs of the petition.”

Learned counsel for the petitioners would submit that the petitioners were initially appointed as Grade IV in the department of Tribal Welfare Development between the years 1989-1997. It is stated that the petitioners had completed their 10 years of service, therefore, the petitioners, on the basis of
order dated 08/09/2008 issued by the office of Collector, Rajnandgaon (Department of Tribal Welfare), are entitled as permanent status and their pay-scales are against Class IV sanctioned post i.e. Rs.2550-55-2260-60-3200 per month. He further submits that for grant of the said pay-scale, the petitioners moved their representation before the respondents authorities for receiving the sanctioned pay scale after
4 completing the ten years of their services as per the order dated 08/09/2008, however, till date, no decisions has been taken on the representations submitted by the petitioners, therefore, it is prayed that the writ petition may be disposed off directing the respondent No.3-Collector Rajnandgaon to consider and decide the said representations as early as possible.
3. Learned State counsel does not opposes the prayer made by counsel for the petitioner.
4. I have heard learned counsel for the parties, perused the pleadings ad documents.

Having considered the submission made by learned counsel for the parties, the writ petition is disposed of directing the respondent No.3-Collector, Rajnandgaon, Distict:Rajnandgaon to consider and decide the representations of the petitioners as early as possible, in accordance with law on its own merits.
