Learned advocate for the petitioner submits that the petitioner himself was assaulted and has been made an accused in the present case. Learned advocate for the State opposes the prayer for anticipatory bail and draws the attention of the Court to the injury report. I have compared the injury report on the relevant date. Having considered the overall circumstances and the initial injury, which is reflected, I am of the opinion that both the complainant and the petitioner entered into a scuffle thereafter, the case was registered by exaggeration. Having regard to the same, I am inclined to grant the anticipatory bail of the petitioner. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- each with two

sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also abide by the conditions laid down under Section 438(2) of the Cr. P.C/482(2) of the BNSS. As the investigation of the case is in progress, the petitioner shall make himself available as and when called for by the Investigating Officer of the case. Accordingly, the application for anticipatory bail being CRM(A) 1793 of 2026 is allowed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
