Learned advocate appearing for the petitioner submits that the factual aspect of the complaint relate to incident of 2021 and the case has been initiated in the year 2026 after there was a change of administration.
Learned advocate for the State vehemently opposes the prayer for bail and submits that there are cases of extortion and prima facie there are supporting evidences which are available in the case diary.
Having regard to the fact that the incident complained of is of the year 2021 and the complaint has been furnished to
2 the police authorities in the year 2026, I am of the view that the investigation of this case can continue but the custodial detention of the present petitioner may not be warranted in the facts and circumstances of the case.
Accordingly, prayer for anticipatory bail of the petitioner is allowed. As such, I direct that in the event of arrest, the petitioner namely, Joydeb Banerjee @ Joydev Banerjee, be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As the investigation is in progress petitioner shall meet with the Investigating Officer firstly within a period of 10 days and thereafter make himself available as and when called for by the Investigating Officer of the case.
Accordingly, CRM (A) 2130 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
