This is the first bail application filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.31/2026, registered at Police Station- Gharghoda, District Raigarh (CG) for the offence punishable under Sections 137(2), 87, 64(1) of BNS and Sections VASANT KUMAR Digitally signed by VASANT KUMAR Date: 2026.07.31 16:11:13 +0530
2 4 & 6 of POCSO Act. 2. The prosecution case is that on 30.01.2026, the complainant lodged a missing report alleging that on 29.01.2026, her minor daughter went to school, but she did not return home, and she suspected that an unknown person had enticed away the victim from the lawful guardianship of her parents. On that basis, matter was registered and during the course of investigation, victim was recovered from the applicant. It is alleged that the applicant had taken the prosecutrix along with him and stayed with her during the period from 29.01.2026 to 12.02.2026, during which the applicant married the victim and physical relations established the applicant. 3. Learned counsel for the applicant contended that the applicant has not committed any offence and he has been falsely implicated in the said case. He further contended that there was some monetary dispute between the applicant and the complainant, false case has been registered against the applicant and charge-sheet has been filed and the applicant is in jail since 12.02.2026, and the trial will take considerable time for its conclusion, therefore, the applicant may be released on bail. 4. Learned State counsel opposes the submission made by learned counsel for the applicant and would submit that at the time of
3 incident, age of the minor victim was 16 years and the applicant was kidnapped her and was committed sexual intercourse with the minor victim, therefore, the applicant may not be released on bail. 5.
Despite service of notice to the victim, none appeared on her behalf. 6. I have heard learned counsel for the parties. 7. Considering the facts and circumstances of the case and further considering the material available on record, this Court is not inclined to grant bail to the applicant. 8. Accordingly, the bail application of the applicant stands rejected. 9. Office is directed to send a certified copy of this order to the trial Court concerned for information.
