... For the State. Learned senior advocate appearing for the petitioner submits that one Raja Bera has been granted anticipatory bail in CR Misc. Case No. 1110 of 2026 by the learned Sessions Judge, Hooghly. Learned advocate appearing for the State, on the other hand, opposes the prayer for anticipatory bail and produces the case diary. I have taken into account the statement of the injured viz. Gurupada Karmakar. So far as the locus of the present petitioner and Raja Bera is concerned, they are on the same footing. Having considered the situational parity which the petitioner is enjoying with the other accused who has been granted the privilege of anticipatory bail, I am inclined to
2 extend the same benefit to the present petitioner. As such, the prayer for anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner viz., Lakshmi Kanta Gupta @ Bapi Baddi shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since the investigation of the case is still in progress, the petitioner shall meet with the Investigating Officer of the case within a period of ten days and thereafter make himself available as and when called for by the Investigating Officer of the case. The application for anticipatory bail, being CRM(A) 2151 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
