Sambhu Roy Vs. The State of West Bengal & Ors.
Mr. Souri Ghosal Mr. Suraj Bhattacharjee … for the petitioner Mr. Dipankar Sen Ms. Nitiksha Biswakarma … for the State Mr. Deborshi Dhar Sekh Sajjad … for the private respondents
The grievance of the petitioner, who is the husband of the respondent no. 4, is that the respondent police authorities have not registered a First Information Report in respect of a complaint being lodged by the petitioner with the concerned police station. Mr. Bhattacharjee, learned Additional Government Pleader, submits that the complaint was lodged with the Inspector-in- Charge, Haldibari Police Station. A Zero FIR at Haldibari Police Station being no.
2 02/Zero dated July 19, 2026 under Sections 126(2)/115(2)/117(2)/3(5) BNS was started and since it was thereafter found that the matter falls within the jurisdiction of New Jalpaiguri Police Station, the same has been transferred to New Jalpaiguri Police Station for taking further action. The private-respondents are represented by their learned advocate. He submits that the complaint lodged by the petitioner is a counterblast to the earlier complaint lodged by the private- respondents with the police authorities. He further submits that pursuant to the complaint lodged by the private- respondents an FIR has already been registered and the investigation is in progress. Since an FIR has been registered, this writ petition stands disposed of by directing the concerned investigating officer to conclude the investigation expeditiously in accordance with law.
