Adv., Mr. Gobinda Ghosh, Mr. Shyamal Barman … for the State. 1. The de facto complainant has been served. None appears on behalf of the de facto complainant. 2. The petitioners pray for pre-arrest bail in connection with Tufanganj Police Station Case No.200 of 2026 dated 14.04.2026 under Sections 137(2)/140(3)/49 of the Bharatiya Nyaya Sanhita, 2023 read with Section 6 of the Protection of Children from Sexual Offences Act and Section 9/10/11 of the Prohibition of Child Marriage Act. 3. The learned advocate for the State opposes the prayer for anticipatory bail and produces the case diary. 4. The petitioners are the father, mother and uncle of the accused who allegedly married the daughter of the de facto complainant. The daughter is 17 years old and the boy is 21 years old. 2 5. Considering the contents of the complaint and the statement of the victim under Section 183 of the BNSS, it appears that the matter relates to a love relationship. 6. Accordingly, I direct that in the event of arrest the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, one of whom must be local to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 corresponding to Section 438(2) of the Code of Criminal Procedure. The further condition is that the petitioner no.1 and petitioner no.3 shall meet the Investigating Officer once a week until further orders and the petitioner no.2 shall cooperate with the investigation. The petitioners shall not leave the jurisdiction of Tufanganj police station. 7. In case the petitioners fail to adhere to any of the conditions as stated above, anticipatory bail stands automatically cancelled without further reference to this Court. 8. The application for anticipatory bail, being CRM (A) 364 of 2026 is allowed and disposed of. 9. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Shampa Sarkar, J.)
