Accused No.2 in SC No.162/2018 pending before the Court of LVIII Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.112/2017 registered by Wilsongarden Police Station, Bengaluru City, for the offences punishable under Sections 302, 307 and 34 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. Perusal of the material on record would go to show that on the merits of the case, petitioner, who was arrested in the present case was enlarged on bail by the Co-ordinate Bench of this Court in Crl.P.No.8316/2018 vide order dated 30.05.2019. Since, the petitioner had not appeared before the Trial Court on - 3 - HC-KAR CNR: KAHC010385242026 NC: 2026:KHC:37945 CRL.P No. 8076 of 2026 the regular dates of hearing, coercive steps were taken against him and he was arrested on 10.12.2024 and on the said day, he was remanded to judicial custody. His bail application filed before the Trial Court in SC No.162/2018 was rejected on 03.02.2026. Therefore, he is before this Court. 4. Material on record would go to show that before the Trial Court, petitioner had remained absent from 18.05.2023 onwards. Therefore, non-bailable warrant was issued against him and his presence was secured on 10.12.2024 and on the said day, he was remanded to judicial custody. It is not in dispute that in the other three criminal cases registered against the petitioner, he has already been enlarged on bail. Insofar as the present case is concerned, on the merits of the case, he has been granted regular bail by the Co-ordinate Bench of this Court in Crl.P.No.8316/2018 disposed off on 30.05.2019. Only for the reason that petitioner had not appeared before the Trial Court on the regular dates of hearing, his presence was secured and he was remanded to judicial custody on 10.12.2024. For the mistake committed by the petitioner by not appearing before the Trial Court on the regular dates of hearing, he has - 4 - HC-KAR CNR: KAHC010385242026 NC: 2026:KHC:37945 CRL.P No. 8076 of 2026 been sufficiently punished. He has undertaken to abide by the conditions that may be imposed on him. Accordingly, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.162/2018 pending before the Court of LVIII Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.112/2017 registered by Wilsongarden Police Station, Bengaluru City, for the offences punishable under Sections 302, 307 and 34 of IPC, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 5 - HC-KAR CNR: KAHC010385242026 NC: 2026:KHC:37945 CRL.P No. 8076 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. f) The petitioner is directed to appear before the Station House Officer, Wilsongarden Police Station, Bengaluru on every first Sunday of the month between 10.00 a.m. and 01.00 p.m. and mark his attendance, till the case registered against him is disposed off before the Trial Court.
