JUSTICE S VISHWAJITH SHETTY ORAL ORDER This petition under Section 439(2) of Cr.P.C. is filed by the State with a prayer to set aside the order dated 01.03.2024 in Crl.Misc.No.1793/2024 passed by the Court of LII Additional City Civil and Sessions Judge, Bengaluru. 2. Learned HCGP submits that the respondent who has been granted anticipatory bail in the present case in Crime No.52/2024 registered by the Rajarajeshwari Nagar Police Station has not cooperated with the police for the purpose of investigation in spite of repeated notices issued to him. Learned Sessions Judge without appreciating the said aspect of the matter has rejected a similar petition filed before the Sessions Court in Crl.Misc.No.4180/2025 by order dated 25.09.2025. 3. Material made available to this Court by the learned HCGP would go to show that investigation of the case is already completed and charge sheet is filed against - 3 - HC-KAR CNR: KAHC010366732026 NC: 2026:KHC:37089 CRL.P No. 7708 of 2026 the respondent herein in Crime No. 52/2024. Therefore, the contention of the learned HCGP that the respondent is not cooperating for the purpose of investigation cannot be appreciated. 4. The learned Sessions Judge after appreciating the fact that the respondent, who has been granted anticipatory bail in Crime No.52/2024 has complied with all the bail conditions has dismissed the petition filed under Section 439 (2) of Cr.P.C. before the Sessions Court in Crl.Misc.No.4180/2025 vide order dated 25.09.2025. 5.
