CALCUTTA HIGH COURT
IN THE CIRCUIT BENCH AT JALPAIGURI
MAT 92 of 2025 IA No : CAN 1 of 2025
Prosenjit Sarkar VS The State of West Bengal & Ors.
Ms. Madhshri Dutta … for the Appellant. Mr. Salok Sah …for the State. Mr. Kanak Kiran Bandyopadhyay (VC), …for the SSC.
1. The issue involved before us is whether the learned Judge rightly rejected the writ petition, upon holding that the appellant had been repeatedly asking for transfer, although he had to travel only a distance of 32 kms.
2. Mr. Bandyopadhyay, learned advocate for the School Service Commission submits that sometime in 2021, the first application for transfer was rejected as the appellant was a single teacher in the subject. Again in 2022, the appellant applied for transfer. The application was rejected on the ground that the appellant was in the habit of asking for multiple transfers.
3. Such observation of the authority also persuaded the learned Judge to pass the order impugned.

4. However, the issue with regard to transfer of a single teacher in a particular subject has now been settled and the Government has also come up with a methodology as to how the applications for transfer of a single teacher in a particular subject should be dealt with.
5. Under such circumstances, the appeal and the application are disposed of, granting liberty to the appellant to apply for transfer afresh in the portal, if not already applied, and such application of the appellant shall be processed in accordance with law, without relying upon the grounds for earlier rejections and the decision of the learned single Judge passed in Writ Petition No. 1811 of 2025.
6. The decision shall be taken by the authority within eight weeks from receipt of the appellant’s application or if application has already been made, within eight weeks from date, strictly in accordance with the notifications.
7. Parties are directed to act on the basis of the server copy of this order.
