This Writ Petition has been filed by the petition seeking following reliefs:- 10.1 Issue an appropriate writ, order or direction, directing the Respondent No. 2 to initiate and conclude disciplinary proceedings against Respondent No. 7 for his repeated acts of misconduct, use of abusive and defamatory language, and unbecoming conduct towards the Petitioner in the institution; 10.2 Direct the competent authorities to take immediate preventive and corrective measures, including ensuring a safe and dignified working environment for the Petitioner. 10.3 Issue a direction to transfer Respondent No. 7 from Government High School, Madanpur, Block Bilha, District Bilaspur, in order to prevent further harassment and interference with the Petitioner's service conditions. 10.4 Pass any other order or direction which this 3 Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.” 2. Learned counsel for the petitioner submits that the petitioner, being the complainant, lodged a complaint against respondent No. 7, pursuant to which an enquiry was initiated. However, the enquiry has not yet been concluded. It is further submitted that, in the meantime, the petitioner has approached this Hon'ble Court seeking a direction for the transfer of respondent No. 7 from Government High School, Madanpur, so as to prevent any further harassment and to safeguard the petitioner's service conditions. 3. Learned counsel for the State submits that the petitioner has no locus to seek the relief prayed for in the present writ petition. It is further submitted that, pursuant to the complaint lodged by the petitioner, an enquiry has already been initiated and the competent authority shall conclude the same and pass appropriate orders in accordance with law. However, the petitioner cannot seek directions from this Court either to the Enquiry Officer or to the respondent authorities to proceed or pass orders against respondent No. 7 in the manner desired by him. It is for the concerned department and the competent authority to take such action against respondent No. 7 as may be warranted in accordance with law. Since the enquiry is already underway, no relief, as prayed for by the petitioner, deserves to be granted. 4. Having heard learned counsel for the parties and upon perusal of the materials available on record, this Court finds that the petitioner is the complainant and that, pursuant to the complaint lodged by him, an enquiry has already been initiated against respondent No. 7 by the competent authority. Since the matter is already under consideration before the concerned authorities, this Court is not inclined to issue any further direction, as sought by the petitioner, including a direction for 4 the transfer of respondent No. 7 or for taking specific action against him in respect of the alleged use of abusive and defamatory language. It is for the competent authority to conduct the enquiry, examine the allegations, and take such action as may be warranted in accordance with law. At this stage, no case is made out for interference by this Court in the exercise of its writ jurisdiction. 5. Accordingly, this petition being bereft of merit is hereby dismissed. 6.
