The present MCC has been filed seeking restoration of WPS No. 4275 of 2026, which was dismissed for want of prosecution vide order dated 02.07.2026. 2. Learned counsel for the applicant/petitioner submits that despite due compliance of the order dated 15.06.2026 by depositing the process fee on 17.06.2026, none could appear on behalf of the petitioner when the matter was taken up on 02.07.2026, as learned counsel was under the bona fide impression that the case would be called as per its serial number in List-2 and, at the relevant time, was appearing before the Coordinate Bench. It is submitted that the non- appearance was neither deliberate nor intentional and that the petitioner has been diligently prosecuting the writ petition. Hence, restoration of WPS No. 4275 of 2026 is prayed for. 3 3. On due consideration of the submissions made and for the reasons assigned in the application, duly supported by an affidavit, this Court is satisfied that sufficient cause has been shown for restoration of WPS No. 4275 of 2026. 4. Accordingly, the MCC is allowed. The order dated 02.07.2026 dismissing WPS No. 4275 of 2026 for want of prosecution is recalled.
