AGP., Mr. Rajdeep Mantha. ......for the State. 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. Petitioner is father of minor girl who went missing from 2nd January, 2026 and yet to be recovered. It is submitted on behalf of the petitioner that petitioner’s daughter previously left home with respondent no.5 on two occasions and she was subsequently recovered. It is submitted that after petitioner’s daughter went missing on 2nd January, 2026, till date, police authorities have not been able to trace her out. 3. Prayer is made in this writ petition for execution of warrant issued against respondent no.5 in connection with previous criminal prosecution, which was initiated in connection with the incident wherein petitioner’s daughter went missing. 2

Mr. Das, learned Additional Government Pleader representing the State respondents has filed a communication dated 23rd July, 2026 of Inspector-in- Charge, Nakashipara Police Station and same is taken on record. Copy of the said communication dated 23rd July, 2026 is made over to the learned advocate representing the petitioner. 5. It is disclosed in the said communication that in connection with Nakashipara Police Station Case No.901/2025 dated 23rd August, 2025, though warrant was issued but same could not be executed in spite of frantic search made by the police authorities to find out respondent no.5. 6. It is also submitted that respondent no.6 is on bail in connection with Nakashipara Police Station Case NO.10/2026. Attention of this Court has also been drawn to the statement made by the daughter of the petitioner under Section 183 of BNSS, 2023 in connection with Nakashipara Police Station case No.975/2025 dated 11th September, 2025 which reveals amorous relationship between the daughter of petitioner and respondent no.5. 7. Taking note of the communication dated 23rd July, 2026, concerned police authorities are directed to make further endeavour to find out daughter of the petitioner as well as respondent no.5 at an early date. If aforesaid persons are traced out, in that event
3 necessary steps shall be taken in accordance with law for execution of warrant. 8. With the aforesaid observation, writ petition stands disposed of. 9.
