Memo of evidence filed on behalf of the State is taken on record. Learned advocate appearing for the petitioner submits that the petitioner is unnecessarily being detained and kept behind the bar as the prosecution is unable to complete the evidence. The petitioner is in custody, who is innocent of the charges. None of the witnesses deposed against the petitioner in spite of the same he is languishing in jail. Some of the accused persons have been granted bail. Learned advocate for the State opposes the prayer for bail and submits that the locus of the present petitioner is completely different from the other accused, who have been granted bail. All the witnesses have been completed including the examination-in-chief of the Investigating Officer and presently the cross-examination of the Investigating Officer is in progress.

Having considered the stage of the case, I am not inclined to grant bail to the petitioner. The learned Trial Court is directed to ensure the presence of the Investigating Officer and the same be concluded within six weeks from the date of communication of this order. Accordingly, CRM (M) 1423 of 2026 is dismissed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
