1. Affidavit of service filed on behalf of the petitioner is taken on record. 2. Matter is heard in presence of the learned advocates representing the petitioner and State respondents. 3. Learned advocate representing respondent no. 5 appears on virtual mode. 4. Learned advocate representing petitioner submits that petitioner is a political person and contested elections previously being member of a particular political party. Certain public statements were made by the petitioner
2 which according to the learned advocate was edited in a manner that produced different meaning resultantly drew flak. Concern is also expressed that due to posting of edited version of the speech on facebook page petitioner was trolled. There are certain threats offline and online prompting the petitioner to approach this Court with the present writ petition seeking direction upon the concerned police authorities to provide protection. Prayer is also made for directing respondent no. 5 to take steps for removal of those obnoxious postings on intermediary platform. 5. Ms. Amee Rana, learned advocate representing respondent no. 5 submits that if Court decides for taking steps taking note of obnoxious postings on facebook page in that event necessary steps can be taken. 6. Learned advocate representing Cyber Crime Police Station, Kolkata has filed a communication dated 29th June, 2026 and same is taken on record. Copy of the said communication is made over to the learned advocate representing petitioner. 7. It is disclosed in the said communication that during preliminary enquiry relevant URLs were provided by the complainant including accompanying materials and accordingly posts
3 were examined. It was found that facebook posts were no longer available. 8. State respondents are represented by Mr. Das, learned Additional Government Pleader who submits that steps have been taken by the concerned authority of Cyber Crime Police Station. It is also submitted that for not registering FIR petitioner needs to approach appropriate authority and there is availability of alternative remedy under Section 175(3) BNSS, 2023. 9.
Having considered the submissions made on behalf of the parties it appears that concern expressed by the petitioner relating to obnoxious facebook postings is addressed since on enquiry it was found that those obnoxious postings are no longer available. 10. However, petitioner apprehends further offline threat as a result whereof prayer is made for directing the police authorities to take steps accordingly. In the communication dated 29th June, 2026 it is disclosed that petitioner is a resident under Nischinda Police Station, Howrah Police Commissionerate. 11. Taking note of the facts that petitioner was subjected to online trolling and there is apprehension of offline threat, concerned police authorities are directed to provide
4 protection to the petitioner, if situation so arises. 12. However, it is also disclosed in the communication dated 29th June, 2026 that no FIR has been registered as yet; if petitioner is aggrieved by not registering FIR in that event petitioner shall be at liberty to approach the jurisdictional Magistrate under Section 175(3) BNSS, 2023 in pursuit of remedy. 13.
