The factual matrix in all the above captioned writ petitions being the same, they were heard analogously and are being disposed of by this common order. In sum and substance, the reliefs claimed in all the writ petitions are identical. For the sake of convenience, WPC No.2465/2024 is taken as the lead case for disposal of all the writ petitions and the reliefs claimed therein read as under : (i) Issue appropriate writs/orders/directing the respondent authorities to follow the due procedures in initiating and concluding the proceedings of land 12 acquisition and strictly adhere to the provisions contained in Section 3 of the National Highways Act 1956 and further ensure the application of the provisions relating to land acquisition compensation, rehabilitation and resettlement under The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. (ii) Issue appropriate writs/orders/directing the respondent no. 06 the Collector, district Jashpur to take all necessary steps to revise and update the market value of the land being acquired under the proviso mentioned in Section 26 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. (iii) Issue appropriate writs/orders/directing the respondent authorities to conclude the said acquisition proceedings by making payment to the petitioners herein Award of Compensation Amount as contemplated under the provisions of the national Highways Act 1956 along with Interest @ 12%per annum till the amount is paid. [(iv) Issue appropriate writs/orders/directing the respondent authorities to resurvey, notify and demarcate the land which have been missed or left out but have been acquired for the said purpose and not to displace the affected families and the land owners before making the complete payment of fair compensation. (v) Issue appropriate writs/orders/directing the respondent authorities to appoint Arbitrator under Section 3G(5) of the National Highways Act 1956 in 13 the event when the amount determined by the competent authority is not acceptable to either of the parties. (vi) Issue appropriate writs/orders/directing the respondent authorities not to harass, force, mislead or keep the affected families and the land owners under dilemma but clarify and remove the difficulties in fair, impartial and just manner. (vii) That any other relief/order which may be deem fit and just in the facts and circumstances of the case may kindly be granted in the interest of justice. 2. At the outset, Mr. Dheeraj Kumar Wankhede, learned counsel appearing for the Respondent-NHAI submits that the petitioners have an alternative remedy to file an appropriate application under Section 3G(5) of the National Highways Act (in short “the Act”) before the concerned authority and as such, they ought to approach the said authority. 3. At this stage, Mr. Anand Kumar Kujur, learned counsel for the petitioners in WPC No.2465/2024 submits that since the petitioners in this petition have already moved an application under Section 3G(5) of the Act before the competent authority, this petition may be disposed of with liberty reserved to the petitioners to approach this Court if any exigency arises in future. 4. So far as remaining petitions are concerned, Mr. Ajeet Kumar Yadav, learned counsel for the respective petitioners submits that all the petitions may be disposed of with liberty to the petitioners to file an appropriate application under Section 3G(5) of the said 14 Act before the concerned authority and further to approach this Court if any exigency arises in future. 5.
