JUSTICE SANJAY VASHISTH Present: Mr. Ruhani Chadha, Advocate, for the petitioner. Mr. M.S. Bhullar, DAG, Punjab. *** SANJAY VASHISTH, J. (ORAL) The instant second petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of Petitioner(s) FIR No. Date Section(s) Police Station District Bhupinder Singh @ Bupinder Singh @ Sagar @ Nihang 209 24.10.2024 115(2), 118(1), 191(3), 190, 324 (4), 351(2) of BNS (Section 118(2) of BNS added later on) Beas Amritsar Rural 2. First bail petition, i.e. CRM-M-11603-2026, filed by the petitioner was withdrawn, at that stage, on 18.03.2026. This is the second bail petition. 3. FIR in the instant case was registered at the instance of complainant-Ravijot Singh, naming total of ten accused (i) Baljit Singh, RAJAN 2026.07.15 10:01 I attest to the accuracy and integrity of this document CRM-M-24310-2026(O&M) 2 President, BJP Party; (ii) Harjinder Singh @ Jinder; (iii) Gurpreet Singh; (iv) Bahadar; (v) Banian; (vi) Bhindi; (vii) Amandeep Singh alias Abmo; (viii) Sagar Nihang; (ix) one unidentified lady; (x) Deepu; and 5–6 unidentified persons. 4. Learned counsel for the petitioner reads out the vernacular of the FIR and submits that petitioner is attributed a datar blow on left leg below knee to the injured Ravijot Singh, which was declared grievous in nature. Injured Ravijot Singh has suffered total 05 injuries and 03 of the injuries are already declared simple and injuries No.2 and 4 have been declared grievous in nature. Further, submits that other co-accused, namely, Harvinder Singh alias Deepu, vide order dated 14.07.2025, passed in CRM-M-35444- 2025, titled as, “Harvinder Singh alias Deepu v. State of Punjab and another” (Annexure P-2) and Gurpreet Singh @ Bahadur, vide order dated 13.08.2025, passed in CRM-M-43255-2025 (Annexure P-3) had been granted regular bail. Further, submits that another co-accused-Baljit Singh, vide order dated 24.12.2025, passed in CRM-M-73527-2025 (Annexure P- 4), had also been granted anticipatory bail and had been confirmed by this Court. Therefore, claiming parity, learned counsel prays for grant of concession of regular bail to the petitioner. Lastly, counsel contends that role assigned to the petitioner is different from datar blow on the left leg, which was declared as grievious in nature. His involvement seems to be highly doubtful, which is to be determined during the course of trial. Moreover, petitioner has already RAJAN 2026.07.15 10:01 I attest to the accuracy and integrity of this document CRM-M-24310-2026(O&M) 3 undergone incarceration period of more than 07 months inside jail, thus prays for grant of regular bail. 5. Learned counsel for the petitioner on examining the facts from record is unable to dispute the factual averment, though submits that inadvertently, complainant mentioned injury on right leg instead of left leg. 6. Learned State counsel is unable to controvert the submission made by learned counsel for the petitioner. However, he vehemently submits that if the petitioner is granted concession of bail, there is every likelihood of him being absconding from the trial and again can indulge in similar kind of activities. 7. This Court has heard the learned counsel for the parties concerned, and has also gone through the record before it. 8. As per the totality of circumstances, and the facts/allegations levelled against the petitioner, and the factors noticed hereinabove, I deem it appropriate to grant the concession of bail to the petitioner. Consequently, prayer made in the present petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 9. Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly. 10. Any of the discussion done and recorded hereabove, shall not be construed as an expression of opinion on the facts of the case. Therefore, RAJAN 2026.07.15 10:01 I attest to the accuracy and integrity of this document CRM-M-24310-2026(O&M) 4 trial Court is expected to decide the case by taking an independent view, on the basis of evidence available on record, as expeditiously as possible, in accordance with law. 11.
