1. Heard Mr. Sanjeev Verma, learned counsel for the petitioner as well as Ms. Anusha Naik, learned Deputy Government Advocate, appearing for the State/respondent No.1.

2
“(i) This Hon'ble Court may kindly be pleased to allow the instant Criminal Miscellaneous Petition and quash/set aside F.I.R. / Crime No. 08/2026 dated 20/01/2026, registered at Police Station Mahila Thana, Raipur, District Raipur (C.G.) for the alleged offences under Sections 85 the Bharatiya Nyaya Sanhita (BNS), 2023; (ii) This Hon'ble Court may kindly be pleased to quash/set-aside the charge-sheet/Final Report No.39/2026 dated 02.05.2026 for the offence under Sections 85 and 351(2) of the BNS 2023 submitted by the Mahila Thana Raipur before the learned Judicial Magistrate First Class, Raipur; (iii) Pass any other order(s) or relief(s) which this Hon'ble Court may deem fit, just, and proper in the
facts and circumstances of the case, in the interest of justice.”
3. From perusal of the prayers and pleadings made in the instant petition, it transpires that though the petitioners have prayed for quashing of the charge-sheet as well as the entire criminal proceedings but, have neither challenged the order taking cognizance nor have mentioned the date of order taking cognizance, which goes to show that the prayer drafted by
learned counsel for the petitioner is in a very casual manner and further wasted the precious time of the Court, as such, in the opinion of this Court, the prayer is defective one.
4. Accordingly, the instant petition is dismissed on this ground alone with liberty to file afresh petition with appropriate prayer, subject to
3 depositing a sum of Rs.2,000/- as cost by the petitioner before the Registry of this Court and submit a receipt of the same at the time of filing of the fresh petition, if any, and the amount so deposited, if any, shall be transmitted to the Government Home for Mentally Underdeveloped Children, Mana Camp, District - Raipur (C.G.).
