Mr. Anamitra Banerjee ..for the State The petitioners have filed the present application for quashing of New Town Police Station Case No.422 of 2015 dated 31.08.2015 under Sections 447/325/506/34 of the Indian Penal Code, 1860 including New Town P.S. Charge Sheet No.558 of 2015 dated 31.10.2015 under Sections 447/323/506/34 of the Indian Penal Code, 1860, presently pending as G.R. Case No.3256 of 2015 before the learned Chief Judicial Magistrate, Bidhannagar, North 24 Parganas. It appears that the dispute between the parties has since been amicably settled during pendency of the revisional application. In this regard, the parties have jointly filed a petition of compromise before this Court, being CRAN 1 of 2026.
Having regard to the nature of the alleged offence, this Court is of the view that further continuation of the present proceedings will be an abuse of the process of law. Having regard to the principles laid down by the Hon'ble Supreme Court reported at (2012) 10 SCC 303 (Gian Singh v. State of Punjab), this Court is inclined to exercise its inherent jurisdiction to quash the present proceedings in the interest of justice. Accordingly, New Town Police Station Case No.422 of 2015 dated 31.08.2015 under Sections 447/325/506/34 of the Indian Penal Code, 1860 including New Town P.S. Charge Sheet No.558 of 2015 dated 31.10.2015 under Sections 447/323/506/34 of the Indian Penal Code, 1860, presently pending as G.R. Case No.3256 of 2015 before the learned Chief Judicial Magistrate, Bidhannagar, North 24 Parganas stands quashed in terms of the compromise recorded in CRAN 1 of 2026. Consequently, C.R.R. 1470 of 2026 along with CRAN 1 of 2026, stands disposed of.
