It is stated that a supplementary agreement was also entered into between the parties, wherein as per the revised arbitration clause of general conditions of contract, the matter could be referred to the India Council of Arbitration (ICA), however, no Arbitrator has been appointed even thereafter. Learned counsel for the petitioner, therefore, submits that Arbitrator may be appointed. 3. This Court noticed that as per the revised conditions under Clause 64(3)(a)(ii), Arbitrators from ICA Panel shall be appointed as per the ICA Rules and the same have been allotted by the parties. However, if no appointment is made within one month, the authorities may move appropriate application before this Court. 5. Accordingly, this application stands disposed of.
