1. Affidavit of service filed in court today is taken on record. 2. None appears for the respondent no.10 despite service. It is noticed that even on the last occasion i.e. July 14, 2026 when the matter had been taken up the private respondent remained unrepresented. 3. It was recorded in the last order dated July 14, 2026, that WBSEDCL had submitted that the meter through which the petitioner is presently receiving electricity can itself be installed at the shop room of the petitioner instead of the present place of its installation. 4. Since, it is evident that the petitioner has been receiving electricity supply, upon the petitioner’s application for such supply have been allowed by the
2 electricity authority, and the WBSEDCL authorities have expressed their assent to the meter being installed at the petitioner’s shop room itself, therefore, there should be no impediment in passing an order directing shifting of the meter from the place where it is presently installed to the shop room of the petitioner upon the petitioner bearing the costs for such shifting. 5. Accordingly, the WBSEDCL is directed to shift the electricity meter through which the petitioner is receiving electricity from the present place of its installation to the petitioner’s shop room within a period of two weeks from date of payment of the costs of such shifting and compliance with all other formalities in accordance with law. 6. In case, any resistance is put up by the respondent no.10 in WBSEDCL’s executing such work of shifting, the Officer-in-Charge, Kolaghat Police Station shall render appropriate assistance to the WBSEDCL authority to enable WBSEDCL to execute the work of shifting in terms of this order. The cost for such Police assistance shall be borne by the petitioner. 7. The petitioner shall be put on prior notice as regards the costs to be borne by the petitioner, both for the purpose of shifting as well as for Police assistance. 8.
Since, WBSEDCL authorities have themselves agreed that the petitioner’s meter can be shifted from its place to the petitioner’s shop room, the letter dated June
3 30, 2026 which has been impugned in this writ petition has been rendered ineffective. 9. With the aforesaid observation WPA 16155 of 2026 stands disposed. No costs. ( Om Narayan Rai, J. )
