Mr. Pritam Roy. …for the State. Petitioner is an elected representative apart from being a medical practitioner. Learned advocate submits that he has been implicated in the instant case for political reason. Learned advocate for the State opposes the prayer for bail and submits that the petitioner has illegally received amount of Rs.25,000/- . To that effect, statement of the complainant is available. It has also been contended that there are accusations that bank passbook has been taken away by the present petitioner. Be that as it may, records reflect that the sections for which the investigation is going on are up to seven years of prescribed punishment. In the case diary, I do not also find any 2 materials to suggest that any document relating to housing scheme is available. Having regard to the fact that investigation of the case is in progress, I do not intend to comment on the merits of the case but so far as the custodial detention of the present petitioner is concerned, I am of the opinion that the same is unwarranted given the facts presently available before this Court. As such, the prayer for anticipatory bail is allowed. Accordingly, in the event of arrest, the petitioner, namely, Suman Sapui shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Petitioner shall make himself before the investigating officer of the case within 10 days from date and thereafter continue to meet with him as and when called for till the investigation is over. With the aforesaid observations, CRM(A)1963 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
