Accused No.5 in Crime No.156/2026 registered by Cottonpet Police Station, Bengaluru City, for the offences punishable under Sections 109(1), 115(2) read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.156/2026 was registered by Cottonpet Police Station, Bengaluru, for the aforesaid offences against Zaid and others based on the first information dated 20.05.2026 received from Altaf Pasha, brother of injured Saquib Pasha. During the course of investigation, petitioner herein was arrested on 20.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional - 3 - HC-KAR CNR: KAHC010388012026 NC: 2026:KHC:37948 CRL.P No. 8166 of 2026 Sessions Court in Crl.Misc.No.5094/2026 was rejected on 05.06.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that in the incident that had taken place on the intervening night of 19.05.2026 and 20.05.2026, the allegation of stabbing injured victim Saquib Pasha on his chest with a knife, is found only as against accused No.1-Zaid. Insofar as the petitioner is concerned, it is alleged that he had assaulted the injured victim with his hands and legs. Injured victim, who was admitted in the Hospital was discharged on 26.05.2026. His condition is now said to be stable. It is not in dispute that petitioner has no other criminal antecedents. Accused No.1 is already arrested in the present case along with accused Nos.2 to 5. Accused No.3 has been enlarged on regular bail by this Court in Crl.P.No.8152/2026 disposed off on 21.07.2026. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.156/2026 registered by Cottonpet - 4 - HC-KAR CNR: KAHC010388012026 NC: 2026:KHC:37948 CRL.P No. 8166 of 2026 Police Station, Bengaluru City, for the offences punishable under Sections 109(1), 115(2) read with Section 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
