Order On Board 30/07/2026
1. Heard.
2. This writ petition has been preferred by the petitioner under Article 226 of the Constitution of India seeking following reliefs:- DEEPTI JHA Digitally signed by DEEPTI JHA
2
“10.1 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, order or direction to respondents authorities to conduct the demarcation of the land of the petitioner, which is situated at Parsada, P.H. No.49, Ra., Ni., Ma. – Sirgitti, Khasra No.388/2, 390/3 Rakba 1.1420 and 0.1940 hectare, District Bilaspur, Chhattisgarh after renumbering the land in their own original sheets and Naksha/Map in accordance with law, within stipulated period of time. 10.2 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deem fit. 10.3 Cost of the petition may also be awarded.”
3.
Learned counsel appearing for the petitioner submits that the petitioner has filed an application on 08.12.2025 for demarcation of his land bearing Khasra No.388/2, 390/3 Rakba 1.1420 and 0.1940 hectare situated at Parsada, P.H. No.49, Ra., Ni., Ma. – Sirgitti, District Bilaspur (C.G.), but according to him till date it has not been decided and no demarcation proceedings have been initiated. Hence, the petitioner has filed this petition seeking direction to the concerned Tehsildar, Bilaspur to conduct the demarcation.
4. On the other hand, learned State counsel submits that the he has taken the instructions from the concerned authorities and according to him after rainy season they will demarcate the land without there being any delay.
5. I have heard learned counsel for the parties and perused the material available on record.
6. Considering the facts and circumstances of the case, this writ petition is
disposed of directing concerned Tehsildar to demarcate the land of the petitioner as per the application filed by him within a period of 60 days from the date of passing of this order.
7. Time and again, this Court is directing revenue authorities including the concerned Tehsildar to consider the application, which are being filed by the concerned applicants in respect of the demarcation, correction of map,
3 mutation etc., however, it appears that the concerned authorities are not acting upon the applications and are not passing the orders, due to which the petitioners are restrained to file petition under Article 226 of the Constitution of India only for a limited relief that the respondents/revenue authorities or other authorities may be directed to consider their application and to pass an appropriate order.
8. It is very unfortunate that for some pity reliefs which ought to have been granted by the concerned revenue authorities/other authorities are forcing the petitioners to approach before this Court. Accordingly, the concerned Tehsildar is directed to consider the application filed by the petitioner and decide the same expeditiously, preferably within a period of 60 days from the date of passing of this order.
9. With the aforesaid observations and directions, the instant writ petition stands
disposed of.
10. Interlocutory application(s), pending if any, also stands disposed of. Sd/-
