Learned advocate appearing for the petitioner is in custody for 285 days and the investigation has already been completed. The prosecution has relied upon 14 witnesses in order to prove its case. As such, the petitioner prays for bail. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim under Section 183 of the BNSS as well as the other attending material. I have taken into account the overall circumstances and the fact that the investigation has been completed. Having considered the overall circumstances, I am of the opinion that further detention of the petitioner may not be warranted in the facts of the case. Thus, prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned ACJM, Baruipur, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Court and shall not leave the jurisdiction of District South 24 Parganas without the prior permission of the learned Court. Accordingly, CRM (M) 1477 of 2026 is allowed. Certified copy of the charge sheet furnished by the petitioner is taken on record.
