This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who is apprehending their arrest in connection with Crime No. 300/2026 registered at Police Station – Masturi, District – Bilaspur (C.G.) for the offence punishable under Sections 115(2), 296, 3(5), 351(3) and 109 of the BNS. 2. The prosecution story, in brief, is that on 18.05.2026 at about 08:30 A.M., the complainant along with his father Shiv Kumar Rathore and brother Ashish Rathore had gone towards their agricultural field RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 situated near village Gatora for agricultural work. It is alleged that due to a long- standing dispute regarding partition of ancestral property, the accused persons, namely Suresh Rathore and Ram Kishore Rathore, intercepted them and started abusing them in filthy language. Thereafter, accused Suresh Rathore allegedly assaulted Shiv Kumar Rathore with a tangi (axe-like weapon), while accused Ram Kishore Rathore allegedly assaulted the complainant party with a rod and stick, causing injuries to Shiv Kumar Rathore, Ashish Rathore and the complainant. It is further alleged that after the assault, the accused persons threatened the complainant party with dire consequences and left the spot. On the basis of the report lodged by the complainant, FIR was registered at Police Station. Hence, this application. 3. It has been argued by the learned counsel for the applicants that the applicants have been falsely implicated in this case.
It is further submitted that there are cross reports of the incident and both the parties have received injuries, and the cross case lodged by the applicant’s side against the complainant party is Crime No.302/2026, registered at the same Police Station for the offence under Section 109 and 3(5) of the BNS, and in the said case the complainant party have been granted anticipatory bail by this Court vide order dated 16.07.2026 passed in MCRCA No.1082/2026. Therefore, he prays for grant of anticipatory bail to the applicants. 4. On the other hand, learned State counsel opposes the bail application and submits that the applicants are not entitled for grant of anticipatory bail in this case. 3
5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicants, it transpires that there are cross reports of the incident and both the parties have received injuries, and the cross case lodged by the applicant’s side against the complainant party is Crime No.302/2026, registered at the same Police Station for the offence under Section 109 and 3(5) of the BNS, and in the said case the complainant party have been granted anticipatory bail by this Court vide order dated 16.07.2026 passed in MCRCA No.1082/2026, at this stage without expressing any opinion on merits, this Court is of the view that the applicants are entitled to be granted anticipatory bail in this case. 7.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Suresh Kumar Rathore and Ram Kishore Rathore, on executing a personal bond with one surety each in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size
4 photo having printed the adhaar number on it, which shall be verified by the trial Court. (e)The Applicant shall not involve themself in any offence of similar nature in future. Sd/-
