2. The petitioners are apprehending their arrest in connection with Saraidhela P.S. Case No.219 of 2025 for the alleged offences registered under Sections 127(2), 115(2), 118(1), 117(2), 109, 3(5) and 352 of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned C.J.M., Dhanbad.

Learned counsel appearing for the petitioners submits that there are case and counter case between the parties and both the sides are neighbour. He further submits that the altercation took place on the eve of Diwali with regard to lighting of candle. He then

submits that petitioner No.2 has received the grievous injury and informant’s side has also received the injury. He next submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.15 of the petition.

Learned counsel appearing for the State opposed the prayer and submits that the allegation of assault are there.

Considering that there are case and counter case between the parties and both the sides have received the injury and the petitioners have got no criminal antecedent as disclosed in paragraph No.15 of the petition and in that view of the matter the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
