JUSTICE R.K. PATTANAIK Order No. ORDER 16.03.2026 01. 1. Heard learned counsels for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Nikirai P.S. Case No.407 of 2025 corresponding to G.R. Case No.581 of 2025 pending in the file of learned J.M.F.C. (C.T.) court, Kendrapara on the grounds stated therein. 3. Gone through the F.I.R. as at Annexure-1. The alleged incident is narrated therein. It is informed to the Court that the petitioner happens to be the daughter-in-law of the informant and she is alleged of having committed the overt acts along with her accused-husband, who is on bail. The F.I.R. reveals that the accused persons took away ornaments and other valuables from the possession of the informant. Recorded the submission of learned counsel for the State. Since it is claimed that the co-accused –husband, who was arrested and has been released on bail in the meantime and that the valuable items have not been disposed of by them, this Court though not inclined to grant her pre-arrest bail, but, is of the view that she should surrender before the learned court below for being released with conditions. 4. Accordingly, it is ordered. 5. In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that upon surrender before the court of learned J.M.F.C. (C.T.) court, Kendrapara within a fortnight from today, the petitioner shall be released on bail in connection with Nikirai P.S. Case No.407 of 2025 corresponding to G.R. Case No.581 of 2025 subject to her furnishing a bail bond of Rs.20,000/- (Rupees twenty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case and subject to verification of the claim as to release of the accused-husband. 6.
