1. This is the second bail application filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.715/2024, registered at Police Station Dharsiwa, District Raipur (C.G.) for the offence punishable under Sections 105 & 125 (a) of BNS. 2. The first bail application of the applicant was dismissed on merits vide order dated 07.03.2025 in MCRC No.1079/2025.

The case of the prosecution, in brief, is that the applicant by driving the offending vehicle truck in rashly and negligently run over the truck over the persons sitting in roadside, as such they received injuries and the son of the complainant Aradhya Sahu, his daughter Monika Sahu, his son-in-law Dharmendra Sahu received grievous injuries and his daughter Monika died during treatment. Thereafter a case was registered against the applicant and he was arrested.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in crime in question. He further submitted that the applicant is in jail since 01.01.2025 and out of total 34 prosecution witnesses, only 10 have been examined till date and some of them have turned hostile and trial is likely to take quite long time for its conclusion, therefore, he prays that the applicant be also released on regular bail.

On the other hand, learned State counsel, opposes the bail application and submits that the applicant is said to be the driver of the truck in question, which has crashed two children, one lady and 10 injured persons, due to which a girl namely Monika Sahu died. As such, the bail application deserves to be rejected.
6. I have heard learned counsel for the parties and perused all the documents available on record.

Taking into consideration the facts and circumstances of the case, gravity of the offence and further considering that the applicant is the driver of the truck in question, which has crashed two children, one lady and 10 injured persons, due to which a girl namely Monika Sahu died, therefore, I am not inclined to entertain this repeat bail application.

Accordingly, the bail application of the applicant – Mahendra Kumar Korethi, involved in Crime No.715/2024, registered at Police Station Dharsiwa, District Raipur (C.G.) for the offence punishable under Sections 105 & 125 (a) of BNS, is rejected. However, the Trial Court is directed to expedite and conclude the trial expeditiously, preferably within a period of 6 months from today. Sd/- (Ramesh Sinha) Chief Justice Nirala
