Learned advocate appearing for the petitioner submits that the petitioner is in custody for 10 months and only 6 witnesses have been examined by the prosecution out of 39 witnesses cited in the charge-sheet. Learned advocate for the State opposes the prayer for bail. Prima facie from the records, I find that there were seizures of weapons or materials used in connection with the offence on the basis of leading statement of this petitioner and another. Having considered the totality of the circumstances as also the gruesome manner in which the offence is committed, at this stage, I am not inclined to release the petitioner on bail as the 2 prosecution is progressing effectively. With the aforesaid observations, CRM(M)1435 of 2026 is dismissed at this stage. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
