A.Narsimha Reddy, Aged about 2 BSB, J W.P.No.14366 of 2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.3 in not deciding the petitioner revision petition vide Roc.L4/101/2024, filed against the orders passed by respondent No.4 in Roc. No. B/498/2022, dated 02.08.2023, in respect of the agricultural land admeasuring Ac. 2.31 cents in Sy. No. 351/1B situated in Basavapalle (Village), Gudipala (Mandal), Chittoor district as illegal, irregular, irrational and amounts to non- discharge of legal obligation conferred on respondent No.3 and offends Article 14, 21 and 300A of the Constitution of India and consequently direct the respondent No. 3 to decide petitioner’s pending revision petition Roc. No. L4/101/2024, expeditiously in accordance with law in the interest of justice and to pass such other order or orders as this Court may deem fit and proper in the circumstances of the case.” 2. The case of the petitioner, briefly stated, is as follows: Originally, the great grandfather of the petitioner was the owner and possessor of lands in Basavapalle village. Thereafter, the petitioner’s grandfather, late T.Munigodu, became the absolute owner and possessor of land admeasuring Ac. 3.21 cents in Sy. No. 358/1 of Basavapalle village, Gudipala Mandal, Chittoor district. After the death 3 BSB, J W.P.No.14366 of 2026 of the petitioner’s grandfather, being head of the family, his paternal uncle, T. Devarajulu, is taking care of the family properties. Devarajulu filed an Assignment Appeal before the Revenue Divisional Officer, Chittoor vide B/498/2022 seeking cancellation of the fraudulent mutation. However, the Revenue Divisional Officer dismissed the appeal by order, dated 02.08.2023 without assigning valid reasons. While things stood thus, Devarajulu died on 09.06.2023. 3. The contention of the writ petitioner is that he being the legal heir of the original assignee and person in lawful possession and enjoyment of the said land preferred a revision before the Joint Collector due to the death of the paternal uncle of the petitioner, by name, Devarajulu, who initiated the original proceedings before the Revenue Divisional Officer, Chittoor, in D.Dis.B/498/2022, dt.02.08.2023, seeking cancellation of the fraudulent mutation in the revenue records. But, the Joint Collector has not disposed of the revision petition so far. 4. The learned Assistant Government Pleader placed on record a copy of the written instructions and submitted that the revision petition is pending. 5. In view of the same, the Writ Petition is disposed of directing the respondent No.3 / Joint Collector, Chittoor, to dispose of the revision petition of the petitioner within a period of three (3) months from the date of receipt of a copy of this order.
