The learned counsel for the petitioner submitted that while all other facts were correctly recorded in the petition, Section 28 of the NDPS Act, 1985 was inadvertently omitted. This factual omission was not disputed by the learned Special Public Prosecutor appearing for the respondent. 3. Since the amendment sought is only to incorporate Section 28 of the NDPS Act, 1985, this Criminal Miscellaneous Petition is allowed 4.
