Rakib (Rejected) CRM (A) 1892 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Moyna Police Station case no. 138 of 2026 dated 12.04.2026 under Sections 137(2)/140(3)/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Srikrishna Mondal & Anr. ……Petitioners. Mr. Golam Mastafa Mr. Subir Sabud Mr. Surajit Maity .....for the Petitioners. Mr. Shataroop Purkayastha ……for the State. Learned advocate appearing for the petitioners submit that petitioner no.1 is the father and petitioner no.2 is the mother of the boy who has fled with the minor girl. Earlier similar incident was there when the victim was recovered and in the said case the parents being the present petitioners were granted bail on surrendering before the jurisdictional Court. Learned advocate appearing for the State opposes the prayer for bail and submits that till date the minor victim has not been recovered. Having regard to the fact that the minor victim is yet to be recovered and the notices under Section 35(3) of the BNSS has not been complied with, I am not inclined to accede to the prayer advanced by the petitioners. 2 Petitioners would in the circumstances appear before the jurisdictional Court with regular prayer for bail, if so advised. With the aforesaid observations, CRM (A) 1892 of 2026 is dismissed before this Court. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
